Division of Property During Divorce

Division of Property During Divorce

Many married couples would face the division of property during divorce unless they entered into a marriage contract. It is a skilled and well-versed lawyer who can help you with this complicated business.

So far, about 50% of the marriages registered in Ukraine are expected to end annually.

It is a common case that the spouses would intend to divide:

  1. their apartment or house as part of their common property acquired during the marriage. All aspects of such division are regulated by laws, which twists and turns are well-known to our qualified lawyers;
  2. jewelry and cash in banks; however simple it may seem, but their division requires to follow the applicable laws as well;
  3. appliances and vehicles;
  4. land;
  5. and so on.

It should be kept in mind that the court may find that either spouse owns privately certain property, so that such property will be exempt from the division.

As a matter of Ukrainian laws, there is only one marriage, that is, a civil one, while in practice so-called “informal” (common-law) marriage exists as well. The division of property will be somewhat different in Ukraine for each of such marriages.

Division of Property in the Common-Law Marriage

The laws declare that such marriage is fully equivalent to the civil marriage in terms of legal status of the spouses if they live together (life partnership). Each of the spouses may claim a half of the assets acquired during the marriage.

Although, there are certain conditions that will determine how the property must be divided.

  • It is mandatory to prove in court that such common-law marriage actually exists.
  • Such marriage will not be treated as valid if either of the spouses is officially married with another person.

Otherwise, being in a common-law marriage is remarkably similar to the civil one, having some minor differences in procedures.

What Property will be Divided for Sure During Divorce?

The Ukrainian laws are quite clear about this. The laws mandate that, as a general rule, all joint owned property purchased by spouses at the expense of their common money, whether both spouses had jobs or not, must be divided in two.

What Property must not be Divided During Divorce?

There is a list of those things that will not be divided upon division of property in Ukraine:

  • things purchased before the marriage;
  • donations and presents;
  • inherited assets;
  • things purchased by a spouse at his or her sole expense;
  • personal belongings;
  • privatized objects;
  • insurance policies;
  • things and items purchased during departure or living separately;

To avoid problems in court with proving your ownership of commonly acquired property, it is essential to keep documents and have persons who can additionally prove such ownership. Moreover, we recommend seeking the professional support from a  family lawyer as well.
